1. Agreement

By downloading or using Penpal AI ("App"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old, or the age of digital consent in your country, to use Penpal AI.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved by Subsly.

4. User content

• You retain ownership of messages, images, audio, profile details, custom instructions, and imported history you provide.
• You grant us a limited license to process that content to operate the App, provide AI responses, generate images or audio, preserve selected memory, maintain safety, and support reliability.
• You must not submit content you do not have the right to use or content that violates laws, rights, or these Terms.

5. AI outputs

Penpal AI uses artificial intelligence. Outputs can be inaccurate, incomplete, fictional, offensive, or unsuitable. The App is for companionship, creativity, and general assistance only. Do not rely on AI output for medical, legal, financial, emergency, or other professional advice.

6. Subscriptions, boosts, and voice credits

Penpal AI offers weekly auto-renewing subscriptions and one-time consumable in-app purchases. Full subscription terms are available at Subscription Terms.

• Payment is charged to your Apple ID at purchase confirmation.
• Weekly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in Settings > Apple ID > Subscriptions.
• Chat boosts, image boosts, and voice credits are consumable purchases. They do not replace, cancel, upgrade, downgrade, or start a subscription.
• Use the App's restore purchase option to restore eligible purchases and subscription access.

7. Free usage and limits

We may provide limited free usage. Limits, included features, model availability, and fair-use controls may change to protect service reliability and prevent abuse.

8. Prohibited use

• Do not use the App for harassment, threats, impersonation, fraud, abuse, or illegal activity.
• Do not upload or generate sexual content involving minors, exploitative content, hateful content, or instructions for violence or serious harm.
• Do not reverse-engineer, scrape, overload, bypass usage limits, or interfere with the App, APIs, or payment systems.
• Do not present AI output as professional advice or as human-authored where disclosure is legally required.

9. Privacy

We process data as described in the Privacy Policy, including routing text, images, audio, and related context to our systems and AI providers to generate results.

10. Account deletion and termination

You may delete your account in the App or contact support. We may suspend or terminate access if you breach these Terms, misuse the App, or create risk for users, providers, or the service.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of liability

To the extent permitted by law, Subsly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunity.

13. Governing law

These Terms are governed by the laws of the United Kingdom. Courts of England and Wales have jurisdiction, subject to mandatory consumer-protection laws in your country.

14. Apple EULA

Where applicable, Apple's standard licensed application end user license agreement and Apple Media Services Terms and Conditions also apply to your use of the App.

15. Changes

We may update these Terms. Updates will be posted here and, where material, may be announced in-app. Continued use after updates means you accept the revised Terms.
